Amounts of Patent

Domestic patent

· Grant CNY 4,300 for every service patent; Grant CNY 2,500 for every non-service patent;

Grant CNY 850 for invention patents that have been approved by China National Intellectual Property Administration to reduce the relevant patent fees

Grant additional CNY 2,000 for every first invention with protection grant.

Grant additional CNY 1,300 for every invention handled by patent agency companies.

International Patent

· 

Grant CNY 40,000 for every patent with protection grant in the U.S., Japan, the U.K, the E.U. and other regions.

Grant CNY 20,000 for every invention with protection grant in countries or territories along the “Belt and Road”;

Grant CNY 10,000 for every invention with protection grant in other countries or territories. The total grant for every patent shall not exceed CNY 80,000.

Entry into PCT national stage

Grant CNY 10,000 for every patent to the professional applicant, and CNY 5,000 for every patent to the non-service applicant.

Patent subsidy standard (CNY/patent)

Service or non-service Invention patents (Including Hong Kong, Macao and Taiwan), which have been approved by China National Intellectual Property Administration to reduce the relevant patent fees, enter through PCT into national stage (overseas): 

Foreign invention patents (the U.S., Japan, U.K., and Europe)

Foreign invention patents (countries or territories along the “Belt and Road”) 

Annual fees

· 

Grant subsidy for annual fees of those patents for two times which are valid and keeps valid for over 6 years since the application date;

· 

The first time: grant CNY 1,800 for per patent valid for 6 years;

· 

The second time: Grant a lump sum subsidiary for the 7^th-9^th year annual fees, i.e., CNY 1,500 for every patent valid for 7 years, CNY 3,000 for every patent valid for 8 years and CNY 4,500 for every patent valid for 9 years.

· 

Patent holders

The patentees owning more than 20 invention patents with protection grant in the previous year shall be given an incentive subsidy of CNY 30,000, and the subsidy shall be increased by CNY 30,000 for each additional 20 patents.

For the patentee who has obtained the above subsidy and applies for the subsidy again in the current year, only the incremental part of the total quantity of invention patents in the previous year minus the maximum quantity of patents in the subsidy granting year shall be subsidized according to the above standards.

Agencies

· 

Grant CNY 500 for per patent with protection grant in Guangzhou city;

· 

Grant additional CNY 2,000 for the first domestic invention with protection grant;

· 

Grant additional CNY 1,300 for the first domestic invention with protection grant;

· 

Grant no more than CNY 80,000 to the patentee of every international patent with protection grant.

Zhuhai City

Limitations

· 

The maximum annual grant for every unit shall not exceed CNY 2 million.

The patent application fees of two countries could be subsidized when one invention has the protection grant in more than two countries;

The subsidiary application should be submitted to the special fund administration system of the municipal intellectual property bureau (Municipal Science, Industry, Trade and Informationization Bureau) within one year since the issuance of the patent certificate; otherwise, the subsidy shall be deemed as waived up.

Shenzhen City

· Within six months after the applicant obtains the notice of publication and the substantive examination notice (subject to the date of issuance of the notice of substantive examination), the applicant will get a subsidy ofCNY 2,000  for every application after paying relevant fees (if the fee for obtaining the approval of the Patent Office of the State Intellectual Property Administration is reduced and lower than the subsidy amount, the patent application fee and substantive examination fee will be subsidized according to the actual payment), but the patent for non-electronic application will not be subsidized;

Where an invention patent protection is granted in Hong Kong, Macao or Taiwan, the subsidy shall be granted in accordance with the domestic standards for invention patent applications.

Agency

· Within six months after the applicant obtains the invention patent certificate (subject to the protection grant announcement date), CNY 2,000 will be subsidized for each patent. If the applicant entrusts Shenzhen patent agency or a branch of foreign patent agencies in Shenzhen to act as the agent   (the latter pays annual tax over CNY 200,000 in the previous year), additional CNY1,000 will be granted;

However, non-electronic patent applications shall not be subsidized; After Shenzhen patent agencies and foreign patent agencies set up a certain scale branches in Shenzhen (the tax amount of the latter in the last year should exceed CNY 200,000) and act as agents to  apply for invention patents and obtain invention patent certificates, they will be subsidized with CNY 1,000 for each patent, but patent agencies whose electronic application rate is less than 100% shall not be subsidized;

The total annual subsidy to the same intellectual property agency (including patent, trademark and copyright) shall not exceed CNY 500,000.

The first invention

· 

Additional CNY 3,000 shall be subsidized to the unit applying for the invention patent for the first time and getting the certificate, but the non-electronic application shall not be subsided.

· 

After the applicant gets the patent invention certificate and applies for the subsidy, the subsidiary shall be granted in a lump sum in line with the standard above.

· 

Domestic patent

1. Grant CNY 40,000 for every invention patent with protection grant in the U.S., the E.U., Japan and other countries;
2. Grant CNY 20,000 for every invention patent with protection grant in other countries or territories with patent offices; the same international patent may be applied in two countries or territories at most.

Tax subsidy

· The subsidy for overseas invention patents shall be classified according to the tax amount. If the actual tax amount of the same applicant (including enterprises and groups) in the previous year (including the actual amount of national tax, local tax self-paid and withholding taxes) is less thanCNY 100 million (inclusive), the total annual subsidy shall not exceed CNY 1 million; Not more than 5 million yuan for more than 100 million yuan but less than 500 million yuan (including 500 million yuan), not more than CNY 10 million for more than CNY 500 million but less than 1 billion yuan (including CNY 1 billion), and not more than CNY 20 million for more than CNY 1 billion.

· 

Enterprises winning the honors like national intellectual property demonstration enterprises and national intellectual property competitive enterprises are not restricted by stipulations above, but the subsidy for one applicant (Including enterprises and groups) shall not exceed CNY 20 million.

PCT patent

When invention applications are submitted in the PCT way and the application for subsidy is submitted within six months upon receipt of the international search report, CNY 10,000 may be granted for every patent of organization applicants and CNY 3,000 for every patent of individual applicants.

Nanshan District of Shenzhen City

Amount of rewards

1. Inventions: CNY 3,000 (After protection grant)

2. The subsidy for every patent technology implementation project shall not exceed CNY 500,000.

Futian District of Shenzhen City
